Workshop Terms & Conditions
The following terms and conditions form the basis of a contract between Paul Forgham and the person(s) reserving and booking a workshop, purchasing or accepting a gift voucher (‘The Client’).
1. Deposits, Bookings and Payments
1.1 A non-refundable deposit of the amount indicated in the workshop description is required at the time of booking.
1.2 The remaining balance is payable 30 days prior to the agreed workshop start date. If full payment is not made within this time Paul Forgham reserves the right to treat the booking as being cancelled. The deposit will be retained by Paul Forgham.
1.3 If a booking is made within 30 days of the agreed workshop start date then the full amount shall be payable at the time the booking is made.
1.4 The receipt of a deposit does not form a contractual booking. A contract between Paul Forgham and the Client will only exist when a booking has been confirmed by Paul Forgham in writing (normally by email)
2.1 A cancellation made by the Client must be done so by email or in writing.
2.2 If the Client makes a cancellation less than 30 days prior to the agreed start date of the workshop then the full cost of the workshop will be retained by Paul Forgham.
2.3 If the Client makes a cancellation more than 30 days prior to the agreed start date of the workshop then the deposit will be retained by Paul Forgham and the balance refunded to the Client.
2.4 Paul Forgham reserves the right to cancel any workshop should it not be deemed viable for any reason. The Client will be notified and offered a choice of either:
a) booking a place on an alternative workshop (any overpayment will be refunded)
b) or withdrawing from the contract and accepting a full refund of any money paid.
3.1 Paul Forgham reserves the right to make amendments to the details and itinerary of any workshops. In the event of such an amendment substantially changing the itinerary of a workshop the Client will be notified and offered a choice of:
a) accepting the amendment
b) booking a place on an alternative workshop (any overpayment will be refunded)
c) withdrawing from the contract and accepting a full refund of any money paid.
4. Personal Injury and Loss
4.1 Paul Forgham does not accept responsibility or liability for death, physical injury, illness or any other harm caused to the Client unless it arises from a negligent act by Paul Forgham during the course of a workshop at which the Client is fully paid up and taking part.
4.2 Paul Forgham does not accept responsibility for the loss of or damage to any items, personal effects, clothing, money, equipment, photographic or otherwise.
4.3 Personal and equipment insurance is not provided and must be arranged by the Client. It is the responsibility of the Client to ensure that they have the appropriate type and amount of cover.
4.4 Any items of equipment (photographic or otherwise) loaned by Paul Forgham to the Client during the course of the workshop will be the personal responsibility of the Client. Any loss or damage must be paid for by the Client.
4.5 Any such claims shall be subject to English law only and legal proceedings shall be exclusively within the English courts only.
5.1 If the Client has any special requests they should inform Paul Forgham of these prior to the workshop. Paul Forgham will endeavour to meet any reasonable requests but cannot guarantee that they will be met. Unless Paul Forgham has confirmed in writing that such requests have been agreed, Paul Forgham will have no obligation to meet the request.
5.2 Paul Forgham will endeavour to follow the advertised itinerary. However, the Client should understand that a reasonable amount of flexibility will be required within this. A workshop description shall be taken as an indication of what is likely to take place at that workshop and not as a contractual obligation of Paul Forgham to provide the exact details of the description.
5.3 Paul Forgham does not accept any liability for any loss or additional expense caused to the Client by delay or interruption to travel services as a result of weather conditions, civil disturbance, industrial action, strikes, wars, floods, sickness, acts of god, or anything else out of the control and influence of Paul Forgham, such losses or additional expenses are the responsibility of the Client.
5.4 The Client must communicate to Paul Forgham any perceived failure in the fulfilment of this contract by Paul Forgham at the time of the workshop so that the matter can be dealt with and remedied immediately by Paul Forgham if this is practicable. If a complaint arises after the workshop that could not have reasonably been dealt with at the time, the Client should inform Paul Forgham in writing within 14 days of the perceived failure occurring.
5.5 By paying the deposit or full booking fee for a workshop the Client agrees to accept all of the conditions in this contract. If a separate party, or multiple parties pay for a workshop in part or in full on behalf of the Client, that party or those parties will become jointly and severally bound by the contents of this contract.
